TRAIN ME EDUCATION PTY LTD TERMS & CONDITIONS
These Terms and Conditions (“Agreement”) govern your participation in any in-person or online courses provided by Train Me Education Pty Ltd ("TME"), including but not limited to mat and reformer Pilates certifications. By enrolling in and participating in these courses, you agree to the following terms:

  1. Scope of Information
    All materials, discussions, and content shared during TME courses are considered proprietary information and are protected under this policy. This includes, but is not limited to, written materials, presentations, videos, and any other form of communication. Participants are prohibited from reproducing, distributing, or using TME content for any purposes other than personal development and education without express written consent.

  2. Recordings and Use
    Recordings of any TME course or workshop may only be made upon prior discussion and written agreement with Train Me Education Pty Ltd. If a recording is provided by TME, it must not be shared beyond the agreed-upon limit. The information is intended solely for the personal development and educational purposes of the participants. Unauthorised use, reproduction, or distribution is strictly prohibited.

  3. Confidentiality
    All participants must keep the proprietary information confidential and must not disclose, copy, or use any of the information for any purpose other than personal development and education as outlined in the courses.

  4. Liability Disclaimer
    Train Me Education Pty Ltd, its owners, and associated entities are not liable for any injuries, damages, or losses that may occur as a result of applying the information learned in any course in any studio, practical setting, or with clients. Participants acknowledge that they are responsible for their own actions and the implementation of any information or techniques learned during the courses with their clients. Any outcomes, including injuries or adverse effects, resulting from the use of this information are the sole responsibility of the participant.

  5. Intellectual Property and Non-Compete Clause
    The information, content, and intellectual property (IP) shared in TME courses are owned by Train Me Education Pty Ltd, Kira-Leigh Rule, and Anthea Counsel. Participants agree that within 12 months of purchasing any course or content from TME, they shall not create, produce, or sell any courses, workshops, or materials deemed similar to those offered by TME, Kira-Leigh Rule, or Anthea Counsel without express written consent. Violation of this clause may result in legal action.

  6. No Refund Policy
    There will be no refunds once a purchase has been made. It is the sole responsibility of the purchaser to ensure their commitment to the course as no refunds or transfers will be offered.

  7. Access Limitations
    Access to TME courses is granted under specific terms. While participants may have access to the course content for a specified period, access may be terminated at any time if TME discontinues its business operations.

  8. IP Address Policy
    Each access link to TME online courses is valid for use on a single IP address. Sharing the link and accessing it from multiple IP addresses is strictly prohibited and may be flagged as a breach of terms, leading to legal action.

  9. Late Submission Fees
    Late fees will apply to submissions made more than 24 hours after the due date and time, as follows:

  • A late fee of $50 will apply.

  • An additional fee of $10 per day will be charged for each day the submission remains late.
    These late fees will be submitted via invoice and must be paid before certification can be granted.

  1. Makeup Sessions for Missed Face-to-Face Days
    If you miss any in-person course days, you agree to organise a makeup session at an additional cost to your course in order to be eligible to complete your certification. Prices for makeup sessions can be found on the TME website.

  2. Submission Attempts and 1:1 Intensive Makeup Sessions
    For all submissions, you will be allowed up to 3 attempts to pass. If 4 or more attempts are needed, you will be required to book a 1:1, 2-hour intensive makeup session with your head educator, either in person or via Zoom. This session will be at an additional cost and will be used to go over feedback and help you improve your submission.

  3. Required Submissions to Pass
    All submissions, online theory, quizzes, and apprentice hours must be completed and submitted in order to pass the course and receive certification.

  4. No Guarantee of Certification
    By enrolling in the course, you acknowledge that passing the certification is not guaranteed. If additional 1:1 sessions are requested after your final submission and your work is still deemed unsatisfactory, it will be at your discretion whether you continue with additional 1:1 sessions until you pass.

  5. Legal Consequences
    Any violation of these terms, including unauthorised sharing or use of proprietary information, will result in legal action. This includes the use of information provided during TME courses by any individual or entity without explicit written permission from Train Me Education Pty Ltd.

  6. Governing Law
    These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Train Me Education Pty Ltd operates. Any disputes arising from these terms shall be resolved in the courts of this jurisdiction.

  7. Agreement
    By purchasing and participating in TME courses, you acknowledge and agree to these Terms and Conditions. Your adherence to these terms is crucial for maintaining the integrity and confidentiality of the proprietary information shared during TME courses.

  9. Course Availability
    TME reserves the right to cancel or reschedule any course, event, or workshop. If a course is cancelled or rescheduled, participants will be notified and given the option to transfer to another course, or in the case of cancellation, a refund will be offered only if no rescheduled options are available.

  10. Course Content Changes
    TME may update or modify course materials, schedules, and curriculum at its discretion to ensure that the content remains relevant and up-to-date. Participants will be informed of any significant changes that may affect the course experience.

  11. Participant Conduct
    Participants are expected to conduct themselves professionally and respectfully while engaging with course content, instructors, and fellow students. TME reserves the right to remove any participant from a course if their behavior disrupts the learning environment, is abusive, or is otherwise in violation of these terms. No refund will be provided in such cases.

  12. Health and Safety
    For in-person courses, participants are expected to adhere to all health and safety guidelines, including any applicable COVID-19 protocols or other public health requirements. TME is not responsible for any injury, illness, or incident that occurs due to failure to follow these guidelines.

  13. Force Majeure
    TME will not be held liable for any failure or delay in the performance of its obligations under these Terms and Conditions if such failure is due to unforeseen circumstances beyond TME’s control, including but not limited to acts of God, natural disasters, pandemics, or government regulations.

  14. Privacy and Data Protection
    TME collects personal information from participants for the purposes of enrolling in and administering courses. This information will be handled in accordance with applicable privacy laws and TME’s Privacy Policy, which can be reviewed on the website. By enrolling in the course, participants consent to the collection, use, and processing of their personal data for these purposes.

  15. Third-Party Services
    TME may partner with third-party service providers (e.g., payment processors, online learning platforms) to deliver its courses. By enrolling in a course, participants agree to the terms and conditions of any third-party service providers that may be involved in delivering course content, processing payments, or other related services.

  16. Transfer of Rights
    Participants agree that they shall not assign or transfer any of their rights or obligations under these Terms and Conditions to any other party without the prior written consent of TME.

  17. Indemnification
    You agree to indemnify, defend, and hold harmless Train Me Education Pty Ltd, its affiliates, instructors, employees, and agents from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from your participation in the course, including but not limited to any violation of these Terms and Conditions, negligence, or misconduct.

  18. Communication and Notices
    All communications related to your course, including notifications of updates to these Terms and Conditions or other important information, will be sent via email to the address provided at the time of registration. It is your responsibility to ensure that your contact details are up to date. You also agree that all notices, requests, or other communications from TME can be delivered to you by email.

  19. Severability
    If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and Conditions and will not affect the validity and enforceability of the remaining provisions.
